1. Introduction and Scope
These API Terms of Use ("API Terms") govern programmatic access to the IVO HTTP API (the "API"), made available by Internetivo Ltd ("Internetivo", "we", "us", "our"), an EU-registered company.
These API Terms are supplemental to, and incorporate by reference, the IVO Terms of Service (the "master ToS") and the IVO Acceptable Use Policy ("AUP"). Defined terms used but not defined here have the meaning given in the master ToS. If there is a conflict between these API Terms and the master ToS on a matter specific to API access, these API Terms prevail to the extent of that conflict.
By requesting, generating, or using API credentials, or by sending any request to the API, you ("you", the "Developer") agree to be bound by these API Terms. If you do not agree, you must not access the API.

3. Eligibility and Access
3.1 Who May Use the API
Access to the API requires an active IVO account in good standing and is available to Users and approved Developers acting within the permissions granted to their account. You must be at least 18 years old and have the legal capacity to enter into these API Terms. We may require additional verification before granting or expanding API access, and we may decline access at our discretion.
3.2 Credentials Required
Access to the API requires a valid API Credential. Each Credential is issued to, and tied to, the account of its holder. All requests must be authenticated as described in the Documentation. Unauthenticated, forged, or improperly authenticated requests are not permitted.
3.3 Credential Confidentiality
You are responsible for keeping your API Credentials confidential. You must not share, publish, embed in client-side or publicly accessible code, or otherwise expose a Credential. You are responsible for all activity that occurs under your Credentials, whether or not authorised by you. If you know or suspect that a Credential has been compromised, you must notify us promptly by opening a security ticket and rotate or revoke the affected Credential. We are not liable for losses arising from your failure to keep Credentials secure.
4. Acceptable Use of the API
4.1 General
You must use the API only in accordance with these API Terms, the master ToS, the AUP, the Documentation, and all applicable laws. The conduct restrictions in the master ToS and AUP apply in full to your use of the API.
4.2 Rate Limits and Quotas
You must comply with all rate limits, quotas, and concurrency limits that we apply or publish. You must not circumvent, evade, or attempt to exceed those limits, including by distributing requests across multiple accounts, Credentials, or IP addresses for the purpose of defeating a limit. We may apply, change, or enforce limits at our discretion.
4.3 No Circumvention of Limits or Authentication
You must not circumvent, disable, or interfere with any rate limiting, authentication, authorisation, validation, or security control of the API, nor probe, scan, or test the vulnerability of the API or any related system except under a written authorisation from us.
4.4 No Unauthorised Harvesting
You must not scrape, crawl, bulk-export, or systematically harvest data from the API or the Platform beyond what the supported endpoints in the Documentation are designed to return for your legitimate use. You must not use the API to build or enrich a competing dataset, directory, or index of Users, Workers, Clients, Tasks, or pricing.
4.5 No Reverse Engineering or Replication
You must not use the API to reverse engineer, derive the structure of, or replicate the Platform or any part of it, nor to build a product or service that substantially reproduces the Platform's functionality.
4.6 Payload and Size Restrictions
You must respect all request and response size limits, payload format requirements, and field constraints described in the Documentation. You must not send malformed, oversized, or deliberately abusive payloads, and you must not use the API to transmit malware or harmful code.
4.7 Data Minimisation
You must request and retain only the data you need for your stated purpose, and must not store data retrieved from the API for longer than necessary for that purpose. When data is no longer needed, or when an End User or Internetivo requests its deletion, you must delete it within a reasonable period unless retention is required by law.
4.8 Respect for Other Users' Rights
You must not use the API in any way that infringes the privacy, intellectual property, or other rights of Users or third parties, and you must honour the rights of data subjects under the General Data Protection Regulation (GDPR) (EU) 2016/679 and applicable Cypriot data protection law.
5. Data Handling and Data Protection
5.1 Roles
Where you obtain personal data through the API and determine the purposes and means of its processing, you act as an independent data controller and are solely responsible for your own compliance with GDPR and applicable data protection law. Where you process personal data on behalf of Internetivo or an End User, you act as a processor and must process that data only on documented instructions.
5.2 Developer Obligations
As a controller or processor of data obtained through the API, you must: provide a lawful basis and appropriate transparency for your processing; implement appropriate technical and organisational security measures; honour data subject rights requests that relate to data you hold; and not transfer data internationally without a valid transfer mechanism. You must not combine API data with other data in a way that re-identifies individuals contrary to their reasonable expectations.
5.3 Data Processing Agreement
Where your access involves processing personal data for which Internetivo is a controller, the IVO Data Processing Agreement ("DPA") applies and is incorporated by reference. You must enter into and comply with the DPA where it applies to your processing.
5.4 No Sale of Data
You must not sell, rent, license, or otherwise commercialise personal data obtained through the API, and you must not disclose it to advertisers or data brokers.
5.5 Privacy Notice
Our handling of personal data within the Platform is described in the IVO Privacy Policy.
6. Availability, Changes, and Versioning
6.1 No Uptime Guarantee
The API is provided on an "as is" and "as available" basis. We do not guarantee that the API will be uninterrupted, timely, secure, or error-free, and we do not commit to any service level or uptime for the API unless agreed separately in writing.
6.2 Changes and Deprecation
We may add, change, deprecate, or remove endpoints, parameters, fields, behaviours, and limits at any time. The API is versioned, and where practicable we will provide reasonable advance notice of breaking changes or deprecations and a migration window. You are responsible for monitoring the Documentation and adapting your Application to remain compatible. Responses follow a documented, structured format described in the Documentation, and you must not rely on undocumented behaviour.
6.3 Throttling, Suspension, and Revocation
We may throttle, suspend, restrict, or revoke any Credential or your access to the API at our sole discretion, with or without notice, including for actual or suspected breach, security or fraud risk, abuse, excessive load, or where required by law.
7. Intellectual Property and Licence
7.1 Licence Grant
Subject to your compliance with these API Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the API solely to build and operate an Application that interoperates with the Platform.
7.2 Reservation of Rights
The API, the Documentation, and all related intellectual property are owned by or licensed to Internetivo. No rights are granted except as expressly set out here. You must not use Internetivo's name, logos, or trademarks (including EUIPO registered trademark 019029107) except as permitted in writing, and you must not imply endorsement or partnership without our prior written consent.
7.3 Restrictions
The licence in Section 7.1 does not permit you to resell, redistribute, or provide the API itself as a standalone service, to remove or obscure proprietary notices, or to use the API outside the permitted purpose.
8. Warranty Disclaimer, Liability, and Indemnity
8.1 No Warranty
To the maximum extent permitted by law, the API is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Internetivo is not a party to, and is not responsible for, any contract or interaction between you and your End Users.
8.2 Limitation of Liability
To the maximum extent permitted by applicable law, Internetivo's total aggregate liability to you arising out of or in connection with the API or these API Terms shall not exceed the greater of (a) the total fees you paid to Internetivo in the 12 months preceding the claim, or (b) EUR 500. Internetivo shall not be liable for any indirect, incidental, special, exemplary, or consequential damages, including loss of profits, loss of data, loss of goodwill, or business interruption. Internetivo is not liable for the acts or omissions of Nodes or third-party service providers.
8.3 Indemnification
You will indemnify, defend, and hold harmless Internetivo, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your Application, your use of the API, your breach of these API Terms, your violation of any law, or your infringement of the rights of any third party.
9. General
9.1 Suspension and Termination
These API Terms remain in effect while you hold any Credential or access the API. Either party may terminate by ceasing access or by revoking Credentials. We may terminate or suspend your access as described in Section 6.3. On termination you must stop using the API and delete cached or stored API data except where retention is required by law.
9.2 Incorporation and Survival
The master ToS and AUP are incorporated by reference. Provisions concerning intellectual property, data protection, warranty disclaimers, limitation of liability, indemnification, and governing law survive termination. The survival, severability, no-waiver, entire-agreement, assignment, force majeure, and change-notice provisions of the master ToS apply to these API Terms.
9.3 Changes to These API Terms
We may update these API Terms from time to time. We will notify of material changes at least 30 days before they take effect where practicable. Continued use of the API after the effective date constitutes acceptance.
9.4 Governing Law and Jurisdiction
These API Terms are governed by the laws of the Republic of Cyprus and EU law where applicable. Subject to the arbitration clause in the master ToS, you submit to the exclusive jurisdiction of the courts of Cyprus.
Experimental Features, Assumption of Risk, and Waiver
The Platform and its features are provided on an "as is" and "as available" basis and may include experimental, beta, preview, or in-development features that may be incomplete, may change or be withdrawn at any time, may not work as intended, and may produce errors. You use the Platform and any such feature at your own risk, and you are responsible for keeping your own backups of important data and files. To the maximum extent permitted by applicable law, Internetivo gives no warranty of any kind and has no liability for, and you release Internetivo from and waive any claim arising from, software bugs or defects, errors, downtime or unavailability, loss of or damage to data or files, failed or delayed transactions, or any other technical issue, including any direct, indirect, or consequential loss. You agree to report any bug, defect, or issue, and any feedback, by opening a support ticket; doing so does not entitle you to any payment, credit, refund, or compensation.
To the maximum extent permitted by applicable law, you are not entitled to and waive any claim for reimbursement, compensation, refund of fees, damages, returns, or other monetary relief from Internetivo arising from these matters. This does not apply to your Credit balance, any Payouts owed to you, or amounts held in escrow for your tasks, which are handled under the Terms of Service and the Refund and Cancellation Policy. Nothing in this section excludes any liability that cannot be excluded under applicable law (including for death or personal injury caused by negligence, fraud, or gross negligence) or your mandatory rights as a consumer or data subject.

These API Terms of Use are governed by the laws of the Republic of Cyprus and EU law where applicable.
