Experimental Features and Beta Disclaimer

1. Purpose
This Disclaimer explains the basis on which the IVO platform ("Platform") and its features are made available, the risks you accept by using them, your responsibility to report issues, and the limits of Internetivo Ltd's ("Internetivo", "we", "us") responsibility. It supplements and forms part of the Terms of Service. If there is any conflict, the Terms of Service govern, save that nothing in this Disclaimer reduces any right you have that cannot be reduced under applicable law.
2. The Platform Is Provided "As Is" and May Be Experimental
The Platform, including any website, web application, mobile application, API, SDK, command-line tooling, browser extension, node software, and any other component, is provided on an "as is" and "as available" basis. The Platform is under continuous development and may include experimental, beta, preview, trial, or in-development features.
Such features, and the Platform generally:
- may be incomplete or provided for evaluation only;
- may contain bugs, defects, or errors;
- may change, be suspended, or be withdrawn at any time without notice;
- may not operate as described or as you expect;
- may produce inaccurate, delayed, or unexpected results; and
- may be unavailable or interrupted.
You acknowledge the above and use the Platform and any experimental feature entirely at your own risk.
3. No Warranty
To the maximum extent permitted by applicable law, Internetivo gives no warranty, condition, or representation of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, or non-infringement. Internetivo does not warrant that the Platform will be uninterrupted, timely, secure, accurate, complete, or error-free, or that defects will be corrected.
You are responsible for keeping your own backups of any data or files you consider important. The Platform is not a backup or archival service.
4. Your Duty to Report Issues and Provide Feedback
You agree to promptly notify us of any bug, defect, error, vulnerability, data issue, or other problem, and to share any feedback, by opening a support ticket (security issues: a security ticket, under the Vulnerability Disclosure Policy).
Reporting an issue or providing feedback helps us improve the Platform but does not entitle you to any payment, credit, refund, fee reversal, or other compensation. Any feedback, suggestion, or idea you provide may be used by Internetivo freely, worldwide, and without obligation or attribution.
5. No Liability for Bugs, Data Loss, or Downtime
To the maximum extent permitted by applicable law, Internetivo shall have no liability to you, and you release Internetivo from, and waive and will not bring, any claim, demand, action, or proceeding for any loss or damage of any kind arising out of or in connection with the Platform or any experimental feature, including:
- software bugs, defects, or errors;
- service interruption, downtime, maintenance, or unavailability;
- loss of, corruption of, or inability to access data or files;
- failed, delayed, duplicated, or incorrect transactions or operations;
- security incidents or unauthorised access not caused by Internetivo's wilful misconduct; or
- any reliance on, or use of, any output of the Platform.
This exclusion applies to direct, indirect, incidental, special, consequential, exemplary, and punitive damages, and to loss of profit, revenue, goodwill, opportunity, business, or data, whether or not Internetivo was advised of the possibility of such loss.
6. No Reimbursement or Monetary Claims
To the maximum extent permitted by applicable law, you are not entitled to, and you waive, any claim for reimbursement, compensation, indemnity, refund of fees, damages, returns, or other monetary relief from Internetivo arising from the matters described in this Disclaimer. Where Internetivo is nonetheless found liable, its total aggregate liability is limited as set out in the Limitation of Liability provisions of the Terms of Service.
7. Your Own Funds Are Not Affected
For clarity, and notwithstanding any other part of this Disclaimer, this Disclaimer does not apply to, and does not permit Internetivo to retain, your Credit balance, any Payouts owed to you, or amounts held in escrow for your tasks. Those amounts are handled solely in accordance with the Terms of Service and the Refund and Cancellation Policy. This protects both you and us, and keeps the rest of this Disclaimer enforceable.
8. Rights That Cannot Be Excluded
Nothing in this Disclaimer excludes or limits any liability or right that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, and any mandatory rights you have as a consumer or as a data subject under European Union and Cypriot law. Where you deal with Internetivo as a consumer, your statutory rights are not affected by this Disclaimer.
